Intentional Torts and Negligence This week's topics relate to the following Terminal Course Objectives (TCOs). B Given an example of corporate liability arising from the sale of defective and dangerous products, propose a business strategy that includes ethical, legal and political considerations to minimize liability for claims of product liability and breach of warranty. C Given a business or commercial contract for the sale of goods and services to a customer, examine the elements of the contract, and determine whether the contract is enforceable under common law or the Uniform Commercial Code. E Given organizational ownership of property (real, personal and intellectual), analyze the rights of an organization regarding the protection of its property and the legal rights and obligations arising out of the use of the property, including environmental impact and issues where appropriate. Our goal this week will be to define "tort" and then distinguish intentional and negligent torts. We will begin with "swimming pool" cases, but I encourage you, as you go through your day, to think about potential liability. Perhaps you drive to work? Tort minefield. Or you use a number of products to get ready in the morning. Potential defective products. What about at work--what potential legal liability might your employer have? Effective distinction between negligent and intentional torts. What are possible legal defenses to tort claims? Let's identify the elements of a product liability claim and possible defenses. Feel free to share interesting examples of product liability lawsuits, verdicts/judgments, and settlements.
