Jamie and Claire are Adelaide Law School students. Every Friday night they are involved in 'Adelaide Swordplay', a live action roleplay game which involves dressing up in armour and mock fighting, using specially designed and made playfight swords. They are light and blunt, and whilst they can inflict mild bruising and the occasional scrape, are not sharp enough to cut or seriously wound participants. Participants are required to undergo a training course before joining in the mock fights and must have their armour and weapons checked every couple of weeks for safety. Before going out with Jamie, Claire had been in a relationship with Frank. Frank was not a member of Adelaide Swordplay, but often went along to their events and stands on the side watching Claire and Jamie. Last week he placed a post on Jamie's Facebook page stating 'If it wouldn't upset Claire so much, I would bash your face in!' After reading this Claire is worried for Jamie's safety, but Jamie laughs it off. Last Friday night there was a very heavy downpour of rain. As Adelaide Swordplay is usually held out of doors, Dougal the organiser of Adelaide Swordplay and President of the Adelaide University Swordplay Club, had to find an alternative venue. He called his brother Callum and asked if the Club could use his large shed. Callum agreed but said 'If any of you damage my shed, I will wring your neck and hang you up on the clothes line'. Twenty club participants arrived at Callum's shed at about 6pm. One of the newer members, Rupert, had brought along his cousin Jenny and her boyfriend Ian. They were keen to join in, but Dougal explained that they needed to do the training first. Not to be deterred when Dougal wasn't looking, Ian picked up a sword and started waving it around. He was unlucky enough to cut through an exposed power cord and sustained a serious burn to his right leg. The sword that Ian had picked up had been poorly manufactured and had a rough edge, which made it very sharp. The sword had been made and brought to Swordplay by Rupert, and not yet approved and tested by Dougal. The power cords had been installed by Callum and should have been wrapped in a protective coating to prevent damage. During a very intense skirmish, things got a little out of control, Rupert went crashing through the wall of the shed, causing a hole about a metre wide. Rupert is not injured. Callum came out of his house, hearing the noise and rushed towards Rupert, yelling 'I am going to kill you!'. Callum had been cooking in his kitchen and was wearing a pink frilly apron and was carrying a wooden spoon and a mixing bowl. As he rushed towards Rupert, Callum tripped over his dog, and the mixing bowl crashed down, hitting Jenny on the head and knocking her unconscious. Worried that Frank might approach Claire and threaten or upset her, Jamie had locked Frank in what both he and Frank believed was the toilet. However, it turned out that it was simply a storage room. Believing he was locked in, Frank frantically bashed against the walls and door. If he had simply looked behind him, he would have noticed a sliding door, which although heavy and difficult to open, was unlocked and opened out onto the driveway. Frank spent an hour in the room and was very distressed when Callum finally heard his screams and came and let him out. Frank sat down on the driveway outside of the shed and waited for the Swordplay to finish so he could offer to walk Claire home. Callum had recently had the floor of the shed replaced by JazzyFloors. Unbeknownst to Callum, JazzyFloors had used a sub-standard product in the floor foundations, which made it unsuitable for weight bearing. The weight of twenty people fighting for an hour finally resulted in the complete collapse of the shed floor, resulting in injuries to Claire, Ian and Rupert. Ian's injuries are the most serious. As he was sitting on the floor waiting for the ambulance to arrive when the floor collapsed, he has been told he will have to have both legs amputated. Already in a state of distress, Frank was very upset seeing Claire lying injured and bleeding on the ground. He has now been diagnosed with clinical depression. Advise the parties generally.
