Assignment title: Management
(a) Students are required to submit a research paper on an area of civil procedure covered in lectures of 2000 words with appropriate references and footnotes. Students must discuss the issues applying their research with appropriate footnotes of cases, legislation and the appropriate theory. This learning task is worth 50% of the assessment. There are three options: two topics set by the lecturer and one the student can arrange with the lecturer. Topics (1) The overall purpose of Victoria's Civil Procedure Act 2010, along with the rules of the court, is to facilitate the 'just, efficient, timely and cost-effective resolution of the real issues in dispute.' Discuss, with reference to case law, literature and statutes. (2) 'Arguably litigation is simply not the appropriate solution for the vast majority of neighbourhood disputes.' Are there instances where litigation may be preferable over mediation? Discuss, with reference to case law, literature and statutes. (3) Student's own topic, to be undertaken after consultation with the lecturer. (b) A take home examination where students will be given a number of case studies/essay topics to solve. Additionally students will be asked to suggest reform agendas in relation to the issues raised by the case study. This learning task is worth 50% of the assessment.
