Preliminary Steps First read the following case: Humzy-Hancock, Re [2007] QSC 34The Questions Each question is worth 2 marks. There are a total of 10 marks for the exercise. 1. Background - The Court What was the name of the Court which determined this case? Explain what type of work this division of the court undertakes. Hint: You may want to look on the Queensland Courts webpage for more information. 2. The Material Facts The first task in solving legal problems is to determine the material facts. What are the material facts in this case? Hint: The task is to distil the facts down to material facts which may only take two or three paragraphs NOT a page! You will lose marks for failing to be concise. 3. The Legal Issues Judges hear cases and determine the issues which are put before them. When lawyers talk about "issues" they mean the main point or the fundamental legal question which needs to be answered. Issues are not the same as the facts of the case. Explain what this case was about and what main issues needed to be decided by the judge who determined the case. Again, keep it material and concise. 4. The Law In every case judges apply the relevant law to the facts to determine the issues. What was some of the relevant law which was being applied to the facts in this case? Hint : It is probably a case based around Queensland legislation. 5. Applying the Law -The Judgment What was the decision of the court in this case?
