Assignment title: Information
QUESTION 1 SCENARIO Bogdan Popov is a citizen of Russia but he has lived in Scotland for ten years. He lives an exciting life, meeting lots of people from all over the world in his job as a tour guide and bus driver for Touropia Travel. Bogdan has often dreamed of being able to travel the world himself. It was a normal weekday when Bogdan went to work to begin a ten day tour around Scotland with a new group of tourists. One of the travellers was a young lady from Australia. Her name was Georgia and Bogdan quickly fell in love with her. She was beautiful, quirky and always up for a laugh. Bogdan eventually plucked up the courage to speak to her and they quickly realised that they had a lot in common. By the end of the tour, Bogdan told Georgia that he had feelings for her and she confirmed that she felt the same way. Georgia was scheduled to leave for Australia straight after the tour but she delayed her travels home because she could not bear to leave so soon when her relationship with Bogdan had started to flourish. Georgia stayed at Bogdan's house for two months. When Bogdan was away on tour, Georgia looked after his house and his pets. Eventually the time came for Georgia to return home. Both Bogdan and Georgia were so upset that they had to be separated, but Bogdan promised her that he would come to visit before the end of the year. Bogdan took on extra tours at Touropia Travel and started another casual job so that he could save up money for his trip to Australia and for an engagement ring so that he could propose to Georgia. When Bogdan had saved up enough money, he lodged his application for a Visitor (Class FA) subclass 600 visa and it was quickly granted. Bogdan booked a seat on the next flight to Australia and was overjoyed to be reunited with Georgia. He proposed to Georgia at the airport and she said yes without a second thought! Georgia's family were concerned that she was rushing into marriage with a man she had just met, but Bogdan and Georgia knew that they had found true love and they did not want to waste any time. They immediately planned their wedding and were married a month and a half later. Georgia and Bogdan came to see you today to seek your assistance with lodging an urgent application for a partner visa. You conduct a VEVO check and notice that Bogdan's visa application is subject to condition 8503. QUESTION: Write a letter of advice in plain English to Bogdan, addressing the following questions: (a) What is condition 8503? (b) Explain whether Bogdan can lodge a valid visa application for a partner visa in Australia? (c) If Bogdan cannot lodge a valid visa application, what steps would he need to take to lodge an application for a valid visa application? What are the chances of success on the basis of the information that you have available? What are your obligations under the Code of Conduct if Bogdan asks you about his chances of success? (d) Do you require any further information or documents from Bogdan? (e) What is the best visa pathway for Bogdan and Georgia? 3 QUESTION 2 If you were going to charge $550 inclusive of GST for preparing a letter of opinion regarding the prospects of success in relation to a partner application (you do not need to go into the merits of the case), what are the mandatory requirements under the Code of Conduct that you would include in your fee agreement? What other documents are you required to provide, if any? Be precise.
